Buying Off-Plan Property in Cyprus
A clear guide for executives buying new-build property in Cyprus: who needs a permit, how title works, which costs apply and what to check.
Who can buy, and what permit is needed
Citizens of European Union and European Economic Area countries may buy property in Cyprus without the permit required of other foreign buyers. Buyers from outside those areas need a permit, issued on behalf of the Council of Ministers, before a property can be registered in their name. It is sensible to settle your own position on this early, because it shapes the timetable of the whole purchase.
How ownership is secured
Ownership is registered with the Department of Lands and Surveys, which issues the title deed in the owner's name. Depositing the signed sale contract with the Department, within the legal deadline, protects you if the seller fails to transfer the property. For an off-plan purchase this deposit matters a great deal, since you are committing before the building is finished.
The seller must attach to the contract a recent certificate from the Department listing any mortgages or other encumbrances on the property. Ask your lawyer to read that certificate before you pay anything beyond a reservation.
Taxes and fees on purchase
Where a purchase carries VAT, usually on new homes from developers, no transfer fee is due. Otherwise the buyer pays a transfer fee to the Department of Lands and Surveys. Cyprus has abolished stamp duty, so newly signed sale contracts no longer attract it. Your lawyer should confirm the exact treatment for the specific unit you choose.
Payment plans, handover and developer track record
Prices in Cyprus are set in euros, which removes one layer of currency uncertainty if you already hold euros. Payment schedules during construction differ from one developer to the next, so compare them project by project rather than assuming a standard. Ask for the expected handover date in writing, and find out what the contract says if completion is late. Look at what the developer has already built and delivered, and visit finished buildings where you can.
