Buying Property in Georgia as a Foreign Investor

What foreign buyers can and cannot purchase in Georgia, how ownership is registered, and what to check before committing to an off-plan project.

What a foreign buyer can own in Georgia

Foreign individuals and companies are free to buy apartments, houses, commercial premises and non-agricultural land in Georgia. For most executives looking at new-build apartments, this means the market is open without a local partner or special structure.

Agricultural land is the main exception. Arable land, pasture and homestead land are generally closed to foreign buyers. If a plot is offered to you, confirm its land category early, before any deposit changes hands.

How ownership actually passes to you

The sale contract must be in writing, and it is usually signed before a notary or at a Public Service Hall. Signing alone does not make you the owner, though.

Ownership passes only when you are registered as the owner in the Public Registry, which is kept by the National Agency of Public Registry. With an off-plan purchase, ask your adviser to explain how your contractual rights are protected during construction and when registration is expected to follow handover.

Checking a property before you commit

Public Registry records are open to anyone. A buyer can look up a property's registered owner, any mortgages and other restrictions before buying. For off-plan units, apply the same discipline to the land the building stands on and to the developer's standing with the registry.

Beyond the registry, the questions that matter most to buyers are the developer's delivery record, the payment schedule during construction, the handover timetable and the location. A short, curated list helps here, because each of those points can then be compared project by project.

Taxes and costs at purchase

Georgia levies no property transfer tax. Registering your purchase does carry a fee, paid to the National Agency of Public Registry.

Ask for a full written list of costs before you reserve a unit, including any developer or legal charges outside the registry fee. Your own tax position at home is a separate matter and is best reviewed with a local adviser.
